"Residents of Florida" sounds like a loophole; If you are a f1 PhD student at a florida university, you will still be able to get a post doc position on h1b at a Florida school if you went to school in state. Or if you live in state somehow on whatever visa status etc. 

Still, this is a step in the right direction.

HB-1 abuse is something I’ve recently become aware of and are horrified by, but we both know that the republicans halting this stuff aren’t doing it because these people are being abused.

So this isn't for the education field but in general. If a company wants to hire someone overseas, shouldn't it be policy to require companies to pay whoever gets the h1b visa twice as much as they'd pay an American? Along with full benefits? It'll prove that the company is really that desperate to hire someone and that they can't find an American to hire.

The universities I’ve been to have an extremely diverse staff of people working there anywhere from Koreans to Romanians.. it makes the professors interesting and the viewpoints diverse, which one of the points of higher education. Only hiring pure Americans for university staff will make the circle of knowledge smaller, and will also ensure we don’t have the best and brightest from other parts of the world moving here to teach, which means the education quality suffers.

University faculty hired through H1B are usually top notch talent in their fields and not something you could easily replace by hiring someone in the country

Meanwhile there are tons of companies that offshore work that could easily be done by US citizens (like customer support) to cheaper labor countries

I have been in the IT Industry for over 20 years, and I have never once believed that the H1B debate is a skills-or-lack-of-skills issue; I have always believed it is an economic issue. I have always been against this program because the companies that use it have never been fully transparent about the details of their hiring process, it's all "trust me, bro, we couldn't find ANYONE that has this skill set," and next thing I see is some import doing level 1-2 work, I'm like, really?

I've worked for a university and seen obscene H-1B abuse up close. A university has no need to employ "exceptional" foreign labor. By definition they are a place of learning. There's a reason why so many foreign students want to come here to learn, and it sure isn't the part-time associate and adjunct professors

Edit: Many don't know why the J-1 visa is superior to H-1B. J-1 allows the student to be paid under a program sponsor (DS-2019) subject to humane controls  including work (no unpaid hours), location (no "consulting"), and scope (no forced duties).

H-1B is a tool to make us better when there is a gap in our education or labor force. It is also a tool for greedy capitalists to exploit cheaper labor from people who are desperate to be here.

Stop Musk and tech companies who abuse it, but don't get rid of it entirely. I suspect De Santis is making Florida education worse with this move, and they will lose several brilliant researchers.

I'm all for trying to encourage education and innovation at home. My concern is that Republicans rarely do these things systematically.

We can't just kick a bunch of professors out of universities and assume we have people in the US ready to take those jobs. This should be transitioned over several years.

I mean this is a complex topic, but kneecaping your universities ability to recruit top tier talent from across the globe is a great way to obliterate up your own higher ed system. There’s a reason other countries are frothing at the mouth to try and co-opt the kind of higher ed system the US is trying to sabotage. What a lot of protectionists don’t understand is that for some positions and talent, there literally isn’t a domestic equivalent now or in the near or medium future or possibly ever. You aren’t gotta suddenly generate top-of-the-line critical specialists in niche fields domestically by blocking the ones that actually exist. It just means another education system will grab them and that institution will rocket ahead with all the benefits the country gets for housing that institution.

It’s a similar idea to tarrifs. It doesn’t always mean X product will only be available for a much higher price. It often means X product won’t be available for any price.

Makes sense to reduce use of H1B for hiring postdocs; outside of very highly-ranked institutions and certain independent fellowships, the career opportunities they open up aren’t worth the reduced pay. With less access to foreign workers, mid-ranked institutions would likely be compelled to hire more permanent staff. That said, the fact that DeSantis identified an “assistant professor from China” as a problematic use of H1B shows his lack of understanding of academia, and in official press release it seems that they softened the language a bit to combat “H1B abuse”.

I work in the tech field and they are absolutely giving jobs to h1bs that they could’ve hired an American for. A lot of Americans are out of work in tech. And a lot of h1bs do not know what they’re doing. I’m not convinced they have the education/work history they claim to because many of them lack very basic knowledge of the field.

Stopping school likely had a very very small effect if at all. You did not make a wrong choice there. Your biggest issue is your uncle’s status and the fact he is funding your school. Your ties to US are just stronger then PH and there is no overcoming that after two rejections. Unless something materially changed you should not have done for a second interview so quickly.

Solution - talk to Shachi Mall (or any visa expert you prefer) and do a proper rejection analysis session. Get professional advice.

Don't panic. The likely outcome of this pandering to MAGA internet trolls is that Florida's public universities will stop sponsoring h1b for non-faculty roles. You cannot be fired due to your immigration status. That's federally prohibited and if even if they did, it would devastate Florida's universities and there would be immediate class action lawsuits. At worst, Florida's public universities would restrict future faculty hires on h1b and shift future faculty hires to O-1 visa. 

Personally, as an academic myself, I never understood why universities hire non-faculty or non-researchers on h1b. Technically they can but it's debatable whether they should.

Kinda..   my company used to sponsor a lot of H1B…  this quarter, the high up ordered to completely halt sponsorship…  these changes are just the start, way more crackdowns are coming… I am pro migration, but the country has changed. Prepare for the worst.. good luck!

Basically they don't believe you're going to return to the Philippines.  How are you paying for your education? How will the degree help you in the Philippines? Many students have relatives in the US so that's not the problem. Is it logical that going to Florida for this program would be worth and time and expense of doing so? These are questions the consular officer are interested in.

Yes, this is the main reason they keep denying you. Best issue is if you are an undergraduate student, get a full funded citizenship or get your parents to sponsor you. Otherwise look for other destinations.
